Malpractice Lawsuit Filed in Case of Toddler Incorrectly Declared Dead

A malpractice lawsuit has been filed by the family of an Orange County, California toddler against the doctor and hospital which allegedly declared her dead - incorrectly.

Mackayla Jespersen was less than 2 years old when she fell into a swimming pool in November 2003. She was declared dead by doctors at Anaheim Memorial Medical Center and had her breathing tube removed. It was not until an hour later that a police investigator noticed the doctors’ mistake and alerted medical personnel.

The lawsuit alleges that Mackayla suffered permanent brain damage as a result of the episode and seeks punitive damages against Anaheim Memorial and Dr. Richard Oxman.
